The origin of Love Jihad in India started in 2000,when there was campaign which started in Karnataka and also in some part of Northern Kerala where many people accused that there is a controversy of Love jihad. Ultimately in 2009,an investigation was carried out by Karnataka CID, all the complaints about the Love jihad was investigated and Karnataka CID said, there is no such thing as jihad and all the accusations are false.
In 2018 a girl named Hadia previous name Akeela from Kerala, a Hindu girl converted to Islam, after that she married a boy Shaifeen and that lead to father of the girl to file a case saying there should be investigation because this is the case of Love Jihad, basically my daughter has been trapped by this Muslim man and they want to take my daughter to Syria and force her to join ISIS. So, Kerala High court enters into picture and unulls the marriage ,Kerala high court said this marriage is not legal. So, this matter reached Supreme Court and Supreme Court reiterated and expanded the scope of Article 21.
Supreme Court said if Article 21 talks about right to life and personal liberty it also talks about right to marry. If a girl and a boy they are adults, state has no power to control them to impose their own views on this adult couple. It is there life, responsibility, no matter how they want to live there life. Even there parents cannot force them to marry parents of there choice.
The Right of two adults to stay together cannot be encroached upon by states.
